Co-Chair of Much’s Health Care group, Nick represents health care providers in transactional, litigation, and regulatory matters. His clients include large medical groups, management services organizations (MSOs), health care facilities, substance abuse treatment centers, clinics, and individual physicians and practitioners. Clients turn to Nick for his deep industry insight when it comes to the formation of businesses and the corporate practice of medicine as well as the complex web of regulatory issues in the health care space.

As a litigator, there are few types of health care-related disputes Nick has not seen. He represents medical providers in:

  • insurance fraud cases and provider disputes
  • business and contract disputes
  • corporate compliance litigation
  • employment and retaliation lawsuits
  • hospital peer review administrative hearings

In his regulatory practice, Nick advises his clients on the Health Insurance Portability and Accountability Act (HIPAA) as well as Fraud, Waste, and Abuse (FWA) laws, including the Stark Law, False Claims Act (FCA), and federal and state anti-kickback laws.

Nick represents health care providers in all manner of regulatory and administrative proceedings, ranging from U.S. Drug Enforcement Administration (DEA) investigations to Medicare and Medi-Cal audits for FWA violations. Nick has also represented clients in hearings brought by the Medical Board of California, the California Board of Registered Nursing, the California Board of Psychology, the California State Board of Pharmacy, the Physical Therapy Board of California, the California Department of Social Services, and the California Board of Occupational Therapy.

Prior to joining Much, Nick founded and managed Fenton Jurkowitz, a health care law firm in Los Angeles, CA. His team joined Much in October 2025.

Much More Than My Work

I serve as a member of the Attorney-Client Mediation and Arbitration Services Committee for the Los Angeles County Bar Association. I work with other committee members to provide attorneys with an opportunity to resolve fee disputes as an economical alternative to the court system.

In my free time, I enjoy playing softball, watching movies, and teaching my three children how to cheer on the Los Angeles Dodgers.

Client Successes

  • Successfully represented a client with residential substance abuse and intensive outpatient treatment facilities against an insurance company’s request for overpayment for services rendered for a former patient. The insurance company requested more than $100,000 repayment based on its findings. After the firm appealed the decision, the insurance company completely dismissed the overpayment request.
  • Successfully represented a physician seeking to terminate his probation in a medical board action. The physician had been placed on seven years of probation. The firm filed a petition to terminate the physician’s probation early and, after a full hearing on the petition, the administrative law judge terminated his probation.
  • Successfully represented a client before the Department of Social Services concerning the client’s license to operate a community daycare center. The Department of Social Services sought to revoke the license and exclude the client, for life, from being involved in any way with the daycare. After a full hearing and presentation of evidence, the administrative law judge found in our client’s favor and placed the licensee on a short suspension and three years of probation. The Department of Social Services subsequently decided to non-adopt the decision, which the firm appealed. The Department of Social Services then reinstated the judge’s ruling and removed the suspension order after hearing the firm’s appeal.
  • Successfully represented a sober living facility client in a precedent-setting appeal concerning a tax audit before the City of Los Angeles. The city assessed the sober living facility’s residents with a sober living facility and transient occupancy tax, which is the same type of tax that is assessed to hotels, motels, etc. The tax was overturned after the firm appealed the decision to the Board of Review, which agreed with the firm’s argument that residents in a sober living facility are not transients as defined under the tax code. If the transient tax had been upheld, it could have applied to all Los Angeles sober living houses and created dire financial consequences for the industry.
  • Defended a Southern California physician in an accusation brought by a medical board alleging several quality-of-care issues and negotiated successfully for a letter of reprimand in lieu of trial.
  • Represented a physician member of a Board of Directors of California of a medical corporation in action to compel disclosure of corporate accounting documents.
  • Defended a Southern California nurse in an accusation by the Board of Registered Nursing alleging that the nurse disobeyed a physician’s orders. After a full trial, the firm obtained a dismissal of all accusations.
  • Represented a physician who was terminated from a medical corporation and denied vested stock options. After filing a lawsuit, the firm negotiated a full settlement that provided payment to physician for all lost wages, full issuance of vested stock options, and payment of all physician attorney fees.
  • Represented and advised numerous physicians’ employees regarding disability discrimination by California medical corporation employers.
  • Represented a California physician in a dispute with a former business partner and the business partner’s corporation. The firm initiated litigation on behalf of the physician by filing a lawsuit seeking damages for breach of contract and fraud. After a full trial, the firm obtained a judgment from the defendant corporation awarding our client $134,000 in damages.
  • Represented a resident physician in a dispute with a residency program regarding termination.
  • Represented numerous physicians in fulfilling mandatory disclosure requirements before the California Medical Board for criminal convictions.
  • Defended a California pharmacy technician in an accusation brought by the California Board of Pharmacy alleging substance abuse violations. The firm obtained a favorable settlement for the pharmacy technician and avoided trial.
  • Represented a California physician in a medical board investigation for overprescribing pain medication.
  • Defended a Los Angeles physician in a lawsuit filed by a former patient for negligence and discrimination. The firm obtained a favorable settlement for the physician limited to nuisance value payment and avoided trial.
  • Successfully represented a physician in an arbitration hearing involving breach of contract allegations by a Southern California hospital.
  • Represented a Los Angeles physician in a dispute with a former business partner regarding breach of a contract and failure to return leased medical equipment. Following full trial, the firm obtained a judgment in favor of our client that included payment in full of all monies owed under the contract and return of leased equipment to client.
  • Represented a physical therapist in an investigation by the Physical Therapy Board of California that culminated in the board taking no action against the physical therapist.
