Ben is an experienced health care attorney who represents clients in a broad range of litigation, regulatory, and compliance matters. He has substantial experience litigating disputes involving health care business operations, employment issues, and contractual matters.

Ben regularly defends health care providers in government investigations and qui tam (whistleblower) lawsuits under the False Claims Act (FCA). He has successfully resolved numerous cases through settlement and trial, including obtaining favorable jury verdicts on behalf of his clients.

He also has extensive experience representing physicians, dentists, nurses, and other licensed professionals in licensing board investigations and disciplinary proceedings, including matters before the Medical Board of California, Dental Board of California, and California Board of Registered Nursing.

In addition, Ben has represented many physicians in medical staff and peer review investigations, hearings, and disputes. He is a trusted advisor in the formation and operation of health care entities, including surgery centers, medical groups, and a wide range of other health care-related organizations.

Ben regularly advises clients on complex state and federal health care regulations, including compliance with the Anti-Kickback Statute, Stark Law, and other Fraud, Waste, and Abuse (FWA) laws.

Client Successes

  • Represented a pharmacist in a contractual dispute arising out of the sale of a pharmacy to a national corporation.
  • Represented a physician employee in an employment dispute with the Los Angeles County-USC Medical Center.
  • Represented a physician in an administrative hearing before the Department of Health Care Services regarding a large overpayment claim against the physician. After discovery and negotiations, the overpayment claim was reduced to a nominal amount.
  • Defended a physician against an action by Blue Shield of California to terminate the physician’s network participation.
  • Defended a physician in an action for damages against a hospital in the High Desert.
