Neil Posner Comments on Recent Illinois Supreme Court Development in Law360

Neil Posner, chair of Much’s Policyholders’ Insurance group, spoke with Law360 about the Illinois Supreme Court’s recent agreement to clarify whether pollution exclusions in standard-form commercial general liability policies apply to industrial emissions allowed under regulatory permits. Posner told the publication that “there was a legitimate tension that should be resolved” and noted that he thought it was appropriate to certify it to the Illinois Supreme Court.
