Jason Rosenthal Discusses Latest Illinois Court of Appeals Ruling on BIPA

Jason Rosenthal, chair of Much’s Commercial Litigation Group, sat down with Digital Insurance to share his thoughts on a recent court decision addressing insurance coverage for Biometric Information Privacy Act (BIPA) claims. There have been conflicting decisions regarding certain policy exclusions, to which Rosenthal noted, “It raises a question as to how the average policyholder ... is supposed to know what their policy covers and does not cover.” He also advised that “it’s important not to take no for an answer” from your insurance company for these claims.
