Jason Rosenthal, chair of Much’s Commercial Litigation group, sat down with Digital Insurance to discuss a recent U.S. Court of Appeals for the Seventh Circuit ruling involving the Illinois Biometric Information Privacy Act (BIPA). The decision upheld a district court’s ruling that an insurance company was responsible for covering an IT company’s alleged BIPA violations.
Rosenthal explained the significance of the ruling and discussed how it will impact corporate policyholders, noting that “insurers will have to take a much closer look, to the extent they weren’t doing so already, as to how they might settle or otherwise resolve these cases.”
