Jason Rosenthal, chair of the Much Commercial Litigation group, talked to Law360 about the Illinois Supreme Court’s ruling that Biometric Information Privacy Act (BIPA) claims are governed by a five-year statute of limitations, rather than a one-year statute. He highlighted a positive aspect of longer BIPA policy periods, noting that “the farther you can go back, the greater chance there is for a BIPA defendant or policyholder ... to get a policy that has more favorable language.”
