Evan D. Brown
Vice chair of the firm’s Intellectual Property & Technology group, Evan advises companies of all sizes on matters pertaining to technology, intellectual property and privacy. His practice covers a wide range of related issues, including licensing, online services, cloud-based technology, big data and analytics, the “internet of things,” social media, advertising, and copyright and trademark protection.
Evan has extensive experience negotiating and drafting licensing and master service agreements for both providers and users of hosted services, including those used by major airlines. His counsel helps his online service provider clients enter into the safe harbor protections of the Digital Millennium Copyright Act (DMCA) and to enjoy the immunity provided by the Communications Decency Act (Section 230). He also advises companies in structuring and executing sophisticated reseller, referral partner, OEM and other similar arrangements.
In addition to his transactional practice, Evan counsels and represents clients in dispute resolution. He is an experienced litigator in federal and state court, defending and asserting clients’ rights in copyright and trademark infringement disputes, breach of contract, and matters related to unauthorized access to computer systems and communications. He has successfully resolved a number of domain name disputes under the Uniform Domain Name Dispute Resolution Policy (UDRP).
Extending to the marketing, advertising and social media realms, Evan provides counsel on web and social media best practices; privacy policies; rights of publicity clearance; advertising liability issues; and trademark clearance, prosecution, maintenance and licensing.
Evan is an adjunct professor at John Marshall Law School in Chicago, teaching a course titled “Intellectual Property in the Digital Environment.” He is also an adjunct faculty member at Chicago-Kent College of Law, where he teaches a full semester course to third-year law students on legal and business negotiations. Evan is a panelist for the World Intellectual Property Organization in Geneva, Switzerland, deciding domain name disputes under the UDRP. He is a frequent public speaker, author and commentator on a wide variety of topics related to law, technology and new media. Evan serves on the Board of Directors of the Indian Prairie Educational Foundation, which enriches education for District 204 students in Naperville and Aurora, Illinois by encouraging student development, supporting educators and recognizing outstanding achievements. He is the Hiking Coordinator for Cub Scouts Pack 101 and an active volunteer with Boy Scouts Troop 8. Evan serves in a number of capacities as a member of Naperville Presbyterian Church.
